Terms of Service

1. Eligibility and age restrictions

• You must be at least 18 years old to access or use the Service.
• You may only upload or use images depicting adults (18+) and only where you have the legal right and express consent required for the intended use.
• You may not use the Service if doing so would violate any applicable law, regulation, court order, or third-party right.

2. Your representations and warranties

By using the Service, you represent, warrant, and agree that:

• You are 18 years of age or older.
• Every identifiable person depicted in any uploaded image is 18 years of age or older.
• You obtained all permissions, consents, licenses, and legal rights necessary to upload, process, transform, and generate content from the image.
• You will not upload any image of a minor, any image obtained unlawfully, or any image of a person who has not consented where consent is required.
• You will not use the Service for harassment, humiliation, blackmail, intimidation, stalking, defamation, impersonation, revenge porn, sexual exploitation, trafficking, extortion, or any other abusive purpose.
• The information and confirmations you provide to us are true, accurate, and complete.

3. Prohibited content and prohibited conduct

You may not use the Service in connection with any of the following:

• Any minor or any person who appears or may reasonably appear to be a minor.
• Any non-consensual intimate image, digital forgery, or sexualized deepfake.
• Any content involving coercion, force, abuse, incest, trafficking, or exploitation.
• Any content that infringes privacy, publicity, copyright, trademark, or other rights.
• Any impersonation of a real person in a deceptive, fraudulent, or abusive manner.
• Any unlawful obscenity, criminal content, or content intended to evade law enforcement.
• Any attempt to bypass our moderation, safety checks, age gates, or content controls.

4. Safety review, moderation, and removal

• We may review uploads, metadata, prompts, outputs, payment signals, and related information for safety, fraud prevention, abuse prevention, legal compliance, and enforcement of these Terms.
• We may reject, suspend, block, remove, preserve, or report any upload, output, order, or user activity at our discretion where we believe there is legal, safety, abuse, or policy risk.
• We may refuse service without notice where required to protect victims, minors, our systems, or our legal obligations.
• If you believe content on or generated through the Service violates rights or law, you may report it to abuse@poundmywife.com.
• We are not obligated to accept, host, retain, publish, reproduce, or re-deliver any upload, output, account, or order, and we may disable access or decline service at any stage where we determine that operational, legal, payment, safety, reputational, or policy risk is unacceptable.

5. User responsibility and assumption of risk

You are solely responsible for the images you upload, the rights and permissions you rely on, the legality of your instructions and intended use, and the consequences of using the Service. You must independently determine whether you have the required consent and legal basis to upload and use any image or likeness.

We do not verify the truth of your representations in every case, and your use of the Service does not transfer responsibility for your conduct to us.

You acknowledge that we may rely on your statements, confirmations, and supplied materials unless and until we have reason to investigate further, and that any false, misleading, or incomplete statement you make may expose you to account termination, payment reversal, reporting, civil claims, or criminal liability.

6. Payments, refunds, and order handling

• Prices, taxes, and availability may change at any time.
• Payments may be processed by third-party processors. We do not store full payment-card details.
• We may cancel or refuse any order where we detect policy violations, fraud, chargeback risk, sanctions risk, or other compliance concerns.
• Refunds, if any, are handled according to our posted checkout terms, applicable law, and any mandatory consumer rights that cannot be waived.

7. Intellectual property and rights in inputs/outputs

• You retain whatever rights you lawfully hold in your uploaded materials, subject to the rights needed for us to operate the Service.
• You grant us a limited, non-exclusive right to host, copy, analyze, process, review, and transform your uploads solely as needed to provide, secure, moderate, and comply in operating the Service.
• You may not claim rights in any output to the extent prohibited by law or to the extent it infringes another person's rights.

8. Takedown and abuse complaints

If you are depicted in content, believe your image or likeness has been used without your consent, or wish to report suspected minor-related, exploitative, or unlawful material, contact abuse@poundmywife.com. We may request information sufficient to identify the content, verify the request, and comply with law. We may remove or disable access pending review.

For this MVP, abuse and removal handling is primarily coordinated through email and any limited operational records then available to us. We do not promise that every requested item will remain available for retrieval, reconstruction, or forensic review after processing has completed or temporary operational copies have been cleared.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability.

We do not guarantee that any upload, output, moderation decision, age gate, or compliance measure will detect every violation, every false statement, or every unlawful use.

We further disclaim any duty to pre-screen every submission, to continuously monitor all user activity, or to preserve evidence except to the extent we specifically choose to do so or are required to do so by applicable law.

10. Limitation of liability

To the maximum extent permitted by law, we and our affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, arising from or related to the Service, your uploads, your outputs, or these Terms.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the specific order giving rise to the claim during the 12 months preceding the event, or (b) USD $100.

11. Indemnification

You will defend, indemnify, and hold harmless us and our affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your uploads, your prompts, your outputs, your breach of these Terms, your violation of law, or your violation of any person's rights.

12. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time by posting the revised version on the Site. Continued use of the Service after the effective date of revised Terms constitutes acceptance of the updated Terms.

13. Governing law and local mandatory rights

These Terms are intended to apply to users in multiple jurisdictions, including the EU, UK, and US. Certain local laws may provide non-waivable rights, remedies, or consumer protections. Nothing in these Terms is intended to limit any mandatory right that cannot be lawfully excluded.
